Les règles de l'Organisation mondiale du commerce et la protection des animaux

Abstract

La présente contribution a pour objet d’examiner l’interaction entre le bien-être des animaux et les règles de l’Organisation mondiale du commerce (l’OMC). Bien que la protection des animaux suscite un intérêt croissant dans le monde entier, les considérations non-commerciales – en particulier le bien-être des animaux – n’occupent encore à ce jour que peu de place au sein de l’OMC. La priorité accordée par l’OMC au maintien du libre-échange se traduit en principes d’élimination générale de restriction ou obstacle commerciale. En but de préserver un système commercial multilatéral ouvert, l’OMC limite la capacité des États membres d’imposer des restrictions à l’importation et à l’exportation de produits. Il sera principalement démontrer (par l’analyse de la jurisprudence pertinente) que l’OMC ne tient pas compte des questions relatives à la protection des animaux. Enfin, le présent document fait valoir que l’OMC pourrait réconcilier le droit commercial international et le droit des animaux, afin de promouvoir un système économique international ouvert qui permettra de mieux lutter contre les problèmes de protection des animaux.

The purpose of this paper is to examine the interplay between animal welfare and the rules of the World Trade Organization (WTO). While there has been an increasing interest in animal welfare worldwide, international trade law has often failed to address issues relating to the protection of animals. In fact, the WTO’s agenda to further liberalize international trade by reducing technical barriers to trade has caused many obstacles when addressing animal welfare issues. Specifically, member states are constrained from imposing restrictions on the import and export of products, even if those products threaten the livelihoods of animals. In order to examine international trade law’s contribution, or lack of contribution in the matter, this paper will analyse some of the most important animal welfare cases as well as trade law disputes. Finally, this paper examines thepossibility of a cooperative approach that would allow members to address animal welfare issues through the rules of the WTO.
