Résumé

In the wake of the sexual abuse crisis by clergy that gained notoriety at the beginning of this century, there has been an increased use of administrative decrees when disciplining secular priests, even when there are no delicts involved. Almost universally, priests who are being disciplined have the faculty for celebrating Mass coram populo removed by their diocesan bishop. Celebrating Mass is central to the very life and nature of the priesthood. This thesis looks at the jurisprudence of the Supreme Tribunal of the Apostolic Signatura to see the limits and parameters placed by it around these administrative disciplinary restrictions. It examines the nature of the priesthood from a canonical perspective, comparing and contrasting it to the episcopal order. Finally, the thesis examines in detail the canons on the celebration of Mass to see if, and to what extent, the jurisprudence of the Signatura conforms to the canons. The thesis argues that the mind of the Legislator, as manifested in the canons, rules out the possibility of an administrative restriction on the celebration of Mass coram populo outside of the very specific cases outlined in the 1983 Code of Canon Law.
