LICENCE NON EXCLUSIVE DE THÈSE À L’UNIVERSITÉ D’OTTAWA

1. Au moment où je présenterai la thèse ou le mémoire qui conférera mon grade (« la thèse ») pour qu’elle soit ajoutée au dépôt numérique institutionnel de l’Université d’Ottawa (« l’Université ») pour les documents de recherche et d’enseignement, je comprends que cette thèse sera mise à la disposition du public.

2. Considérant que l’Université désire mettre ma thèse à la disposition du public, j’accorde à l’Université par les présentes une licence mondiale non exclusive, perpétuelle et libre de redevances, lui permettant de :

a) imprimer, reproduire, publier, archiver, préserver, convertir, transmettre et distribuer la thèse n’importe où dans le monde, y compris les métadonnées et le résumé, par télécommunication ou par d’autres moyens, dans tout format ou support qui existe ou qui pourrait exister à l’avenir, à des fins non commerciales et pendant toute la durée du droit d’auteur;

b) ajouter la thèse à des bases de données, des archives, des collections de ressources consultables et des entités analogues, dans tout format ou support existant;

c) autoriser, accorder une sous-licence ou une sous-traitance, ou engager toute action mentionnée aux alinéas a)et b).

3. Je comprends que l’Université peut accorder une sous-licence et présenter la thèse à Bibliothèque et Archives Canada et que tout résumé présenté avec la thèse sera considéré comme faisant partie de la thèse.  

4. Je conserve la propriété du droit d’auteur et des droits moraux qui protègent ma thèse et je peux disposer du droit d’auteur de toute manière compatible avec les droits que j’accorde à l’Université par les présentes. Je promets d’informer des droits que j’ai accordés à l’Université par les présentes toute personne à qui je pourrais céder ou accorder en sous-licence mes droits d’auteur pour les documents sous licence.

5. Je confirme que les déclarations suivantes sont exactes et véridiques :

a) La thèse est mon œuvre originale et elle n’empiète pas sur les droits à la vie privée ni sur les droits de propriété de quiconque. 

b) Je conserve la propriété des droits d’auteur protégeant ma thèse et j’ai le droit et l’autorité de céder la licence conférée par les présentes.

c) La version de la thèse présentée est la même que celle qui a reçu l’approbation écrite de mon directeur de thèse ou l’approbation écrite d’un membre du jury de la soutenance, ou que celle qui a été présentée pour me recommander au grade.

d) Conformément à la Loi canadienne sur le droit d’auteur et des licences, j’ai obtenu l’autorisation écrite du titulaire des droits d’auteur protégeant la documentation dont le droit d’auteur appartient à des tiers et je pourrai présenter la preuve de cette autorisation à l’Université sur demande. 

Je comprends que l’Université peut enlever la thèse de son dépôt institutionnel ou ne plus la mettre à la disposition du public si elle a de bonnes raisons de croire que les déclarations précédentes sont fausses ou inexactes. 

6. L’Université n’est pas responsable de la mauvaise utilisation de la thèse par des tiers qui la consultent par l’entremise de ses installations et de ses systèmes. L’Université n’est pas tenue de poursuivre ces tiers en mon nom ni au nom d’autres titulaires de droits  advenant la violation des droits de propriété intellectuelle ou d’autres droits protégeant la thèse.

THESIS NON-EXCLUSIVE LICENSE TO THE UNIVERSITY OF OTTAWA

1. By submitting my thesis or dissertation for which my degree is established (“Thesis”) to the University of Ottawa’s (“University”) online repository for research and teaching materials, I understand that the Thesis will be made available to the public.

2. In consideration of the University making the Thesis available to the public, I hereby grant to the University a non-exclusive, worldwide, irrevocable, royalty free license, in perpetuity, as follows:

a) to print, reproduce, publish, archive, preserve, convert, transmit, distribute and communicate the Thesis, including metadata and the Thesis abstract, anywhere in the world, by telecommunication or by any means and in any format or medium whether existing or which may come into existence in future for non-commercial purposes and for the full term of the copyright;

b) to include the Thesis in databases, archives, searchable collections of resources and analogous entities in whatever format or medium they exist; and

c) to authorize, sub-license, sub-contract any of the acts mentioned in paragraphs (a)and (b).

3. The University may sub-license and submit the Thesis to the Library and Archives Canada and that any abstract submitted with the Thesis will be considered to form part of the Thesis.  

4. I retain the copyright and moral right in the Thesis and may deal with the copyright in the Thesis in any way consistent with rights granted by me to the University in this non-exclusive license.  I promise to inform any person to whom I may hereafter assign or license my copyright in the Licence Material of the rights granted by me to the University in this non-exclusive license.

5. I confirm the following statements to be true and accurate:

a) The Thesis is my original work and that it does not infringe any proprietary or privacy rights of others. 

b) I own the copyright in the Thesis and have the right and authority to grant the license conferred by this non-exclusive license.

c) The version of the Thesis hereby submitted is the same version as the one that received the written approval of my thesis supervisor(s) and/or the written approval of a member of the thesis defence jury and/or the one that was submitted in order for me to be recommended for the degree.

d) Where required under the terms of the Copyright Act, I have obtained the written permission of the copyright owner for any third party content used in the Thesis and will supply copies of such upon request by the University.

I understand that the University may remove the Thesis from its repository or otherwise no longer make it available to the public if, in the reasonable opinion of the University, the statements above are false or inaccurate.

6. The University is not responsible for any misuse of the Thesis by third parties who access the Thesis through University facilities or systems.  The University is under no obligation to pursue such third parties on my behalf or on behalf of other rights holders, in the event of breach of intellectual property rights, or any other right, in the Thesis.
